Terms of Service
Last updated: 29 October 2026
These terms are the agreement between you and [company name: to be filled in] ("we", "us") about Tracky: the desktop app, the website trackyapp.gg and the online services the app uses (licence checks, shared rooms, sponsor ads, update checks). The End User License Agreement (what you may do with the app itself), the Privacy Policy and the Refund Policy are part of these terms. By installing or using Tracky, or by buying a plan, you accept them. If you use Tracky for a business, the parts written for consumers do not apply to you where the law allows that.
1. Who we are
[company name: to be filled in], registered office [registered office: to be filled in], Romania; Trade Register no. [Trade Register number: to be filled in]; fiscal code [fiscal code (CUI): to be filled in]; share capital [share capital: to be filled in]. Email: support@trackyapp.gg.
2. What Tracky is
Tracky is a Windows overlay that shows timers you start yourself, with a click or a hotkey. It does not read, change or automate any game. It runs on Windows 10 and 11. Its online parts (licence checks, shared rooms, sponsor ads) need an internet connection.
3. Age
You must be at least 16 to use Tracky's online features. To buy a plan you must be of legal age in your country, or have your parent's or guardian's permission.
4. The free version and its ads
The free version shows an ad window when Tracky starts, unless you have a banked ad-free day; you can bank more days by watching extra ads, within the limits the app shows. The ads come from sponsors we choose. A sponsor is responsible for its own offer: clicking an ad takes you to the sponsor's website, where the sponsor's terms apply, not ours. We may change how the ad system works (length, limits, sponsors) at any time.
5. Paid plans
Who sells them. Plans are sold through Stripe's Link service, which acts as the merchant of record: Link takes the payment, adds and pays the taxes, sends receipts and invoices, and handles payment questions, cancellations, refunds and payment disputes under its own terms (support.link.com). Your bank statement shows "LINK.COM*". We provide Tracky and the licence. [lawyer: confirm this description against Stripe's Managed Payments terms and say which terms the buyer accepts at checkout]
Prices are shown on the Pricing page and at checkout, including the taxes that apply to you.
Subscriptions (Monthly, 4-Month, 1-Year) renew automatically at the end of each period at the price shown to you, until you cancel. You can cancel at any time on the account page ("Manage billing") or through Link; the plan then stays active until the end of the period you already paid for. Before a renewal you receive a reminder by email where the law requires it.
Permanent is a one-time payment for the ad-free version for as long as we offer Tracky (see section 13), on the number of PCs shown in your account. It is not a promise of every future feature or of online services without end.
Licence checks. The paid version checks your licence online when Tracky starts and every few hours while it runs. If it cannot reach our server, it keeps working for 14 days from the last successful check, then shows the free version (with its ad) until it can check again.
Your right of withdrawal (EU consumers). Tracky's licence is digital content supplied at once. Where the law gives you a 14-day right of withdrawal, you are asked at checkout to agree that the supply starts immediately and to acknowledge that you then lose that right. Independently of that, our Refund Policy gives you 14 days to ask for a refund. [lawyer: check that the Managed Payments checkout collects this consent; if not, a "withdraw from contract" function is required since 19 June 2026]
6. Your licence key
Each licence works on a limited number of PCs at the same time (shown in your account; currently two). You can free a PC on the account page or with "Deactivate this device" in Tracky. Keep your key to yourself: it is for your own PCs, not for sharing, lending or selling. Copying Tracky's licence settings to another PC to get around the PC limit is sharing too.
We may switch a licence off (revoke it) when the payment for it was refunded or disputed, when it was bought with a stolen payment method or through test or fraudulent checkouts, or when it is shared or used to get around the PC limit or the room rules in a serious or repeated way. Unless the reason is a refund, a payment dispute or fraud, we tell you first by email and give you a chance to fix it. We keep a record of each such decision and its reason.
7. Shared rooms (paid plans)
Shared rooms let people with paid plans see and change the same timers together. Anyone with a room's code can ask to join it. The room's owner can choose to let people in only after accepting them, and can remove (kick) any member; someone who was removed must be accepted by the owner again before rejoining. The name you choose in rooms, your timers and the room's settings are shared with the other members of the room.
In rooms, do not: use names that impersonate others, insult, harass or threaten people; share offensive or illegal content in timer or group names; try to disrupt rooms you were not invited into; or use more than one connection or licence copy to get around the limits. We may close rooms, remove members or stop someone from using rooms when these rules are broken or to protect the service.
Rooms are offered as they are: they depend on our servers and your connection, and may be unavailable at times (for example during updates). We do our best to keep them running, but do not guarantee that they always work.
8. Acceptable use
Do not: get around the licence check, the PC limit or the ad system; attack, overload or probe our servers or website; use automated tools to create accounts, rooms, requests or ad views; resell or share keys; or use Tracky in a way that breaks the law. What you may do with the app's code is in the EULA.
9. Games and their publishers
Tracky is an independent tool, not affiliated with, endorsed or sponsored by Riot Games, Valve, Hi-Rez Studios, Mojang or Microsoft, or any other game publisher. Game names are used only to say what Tracky can be used with; they are trademarks of their owners. Each game has its own rules about overlays and third-party tools, and they can change. It is your responsibility to follow the rules of the games you play. We cannot promise that a game allows Tracky or that using it will never lead to action against your game account, and we are not responsible for decisions game publishers make about your account.
10. Your content
Pictures and sounds you add to Tracky stay on your PC; we never receive them. You need the right to use them. Timer names, group names and the name you choose for rooms are shared with the members of the rooms you are in.
11. Our content
Tracky, its code, its pictures and sounds, the website and the name "Tracky" belong to us or to our licensors. Open-source parts of Tracky come with their own licences, listed in the notices shipped with the app.
12. Guarantee and liability
Your legal rights. If you are a consumer, you have the legal guarantee that the paid version is as described and works as described (conformity of digital content). Nothing in these terms limits that or any other right the law does not let us limit.
The free version and the online services are offered as they are, as far as the law allows. Timers are only as accurate as what you set and when you start them; Tracky is not meant for anything where a wrong or missed timer could cause harm.
Limit. We are fully liable for damage we cause intentionally or by gross negligence, and for injury to life, body or health. Otherwise, our total liability for all claims connected with Tracky is limited to the amount you paid for Tracky in the 12 months before the event that caused the claim (or [EUR 20] if you paid nothing), and we are not liable for losses that were not foreseeable, such as lost matches, ranks, game items or game accounts. [lawyer: check the wording against Civil Code art. 1355 and Law 193/2000]
13. Changes to Tracky, and if Tracky ends
We improve Tracky and may change or remove features. If a change makes the paid version clearly worse for you during a period you paid for, you may cancel and get a refund of the part not yet used, as the law provides.
If we ever stop offering Tracky, we will tell paying users at least [60] days before, by email and in the app, and refund subscriptions for the time not yet used. A Permanent licence is a payment for the ad-free version while we offer Tracky; we do not promise that Tracky, or a version of it that works without our servers, stays available after that date. [lawyer: is this fair enough for a product called "Permanent" - e.g. bought shortly before the end? The owner may later add a final offline version; this text does not promise one.]
14. Ending the agreement
You can stop using Tracky and cancel a subscription at any time. We may end your use of Tracky's online services for a serious breach of these terms (section 6 for licences, section 7 for rooms). If we end a paid plan for any other reason, we refund the part not yet used.
15. Changes to these terms
We may update these terms, for example when the law or Tracky changes. For paid plans we tell you at least 30 days before a change that matters to you takes effect; if you do not accept it, you may cancel before then. The date at the top always shows the current version.
16. Law and disputes
These terms are governed by Romanian law. If you are a consumer living in another country, you keep the protection of the mandatory rules of your country's law, and you can go to the courts where you live. Please contact us first at support@trackyapp.gg: most problems are solved quickly. You can also use alternative dispute resolution through ANPC (Romania's consumer protection authority): https://reclamatiisal.anpc.ro/.
